TERMS AND CONDITIONS FOR THE PROVISION OF INTERNATIONAL POSTAL SERVICES BY SUPERGLOBAL SP. Z O.O.
Effective as of 01.06.2026
§ 1. General Provisions
- These Terms and Conditions for the provision of international postal services ("Terms and Conditions") define the rules for the provision of postal services by SuperGlobal Sp. z o.o., with its registered office in Jelenia Góra, at ul. Karola Miarki 18, 58-500 Jelenia Góra, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001056965, NIP 6112828434, entered in the Register of Postal Operators maintained by the President of the Office of Electronic Communications under number B-00772, hereinafter referred to as "SuperGlobal" or the "Operator".
- SuperGlobal provides international postal services within the scope covered by its entry in the Register of Postal Operators, these Terms and Conditions, the currently applicable Price List, shipping documents and individual arrangements with the Ordering Party, if such arrangements have been made.
- The area of postal activity of SuperGlobal, in accordance with its entry in the Register of Postal Operators, covers: Abroad.
- SuperGlobal is not a designated operator within the meaning of the Postal Law and does not provide universal services.
- The services provided by SuperGlobal do not constitute universal services. They are international postal services provided under the terms set out in these Terms and Conditions, the Price List, shipping documents and individual service terms.
- These Terms and Conditions and the current Price List are available on the website www.superglobal.com and at parcel acceptance locations, if such locations are operated by SuperGlobal.
- SuperGlobal may perform services independently or with the use of agents, carriers, postal operators, logistics partners, subcontractors or other persons involved in the performance of the service.
- In matters not regulated by these Terms and Conditions, generally applicable law shall apply, in particular the Postal Law, customs regulations, personal data protection regulations and regulations applicable to the international movement of parcels.
§ 2. Definitions
- Operator - SuperGlobal Sp. z o.o., a postal operator entered in the Register of Postal Operators under number B-00772.
- Ordering Party - a customer ordering the performance of a postal service.
- Sender - the Ordering Party or a natural person, legal person or organisational unit authorised by the Ordering Party to send a parcel.
- Recipient - a natural person, legal person or organisational unit indicated as the addressee of the parcel.
- Parcel - an item or items accepted by the Operator for postal handling in international traffic, on the basis of a shipping document or another equivalent document.
- Package - an item or items placed in a single, compact and secured package constituting one element of a parcel.
- Shipping Document - a waybill, label, electronic form, confirmation of posting, parcel number, handover protocol or another document used by SuperGlobal to confirm acceptance of the parcel for processing.
- Price List - the current price list of SuperGlobal postal services, published on www.superglobal.com or made available to the Ordering Party before the service is ordered.
- Additional Service - a service provided alongside the basic postal service, in particular repacking, additional parcel protection, return, customs handling, confirmation of posting or delivery, cash on delivery, storage, redelivery or another service indicated in the Price List.
- Consumer - a natural person performing a legal act not directly related to their business or professional activity.
- Entrepreneur - a natural person, legal person or organisational unit conducting business or professional activity.
§ 3. Scope of Postal Services
- The scope of postal services provided by SuperGlobal to the Ordering Party is determined for a given parcel in the shipping document, electronic form, label, order, Price List, agreement, offer or another equivalent document.
- The services provided by SuperGlobal may include in particular:
- accepting parcels for posting in international traffic;
- preparing parcels for postal handling;
- weighing, counting, marking, labelling, packing or repacking parcels;
- sorting and preparing parcels for further handling;
- moving parcels;
- delivering parcels to Recipients;
- handling parcels in the country of dispatch, transit or delivery;
- handling shipping documents;
- providing information on parcel status;
- handling returns;
- storing parcels where necessary for the performance of the service;
- handling customs formalities where required for a given parcel;
- handling cash on delivery where such service has been agreed;
- taking actions to secure the rights of the Ordering Party in the event of damage;
- notifying the Ordering Party of expected or actual obstacles to the performance of the service.
- SuperGlobal may provide services in the following models:
- point-to-point;
- point-to-address;
- address-to-address;
- address-to-point;
- another model indicated in the Price List, offer, agreement or customer panel.
- SuperGlobal may provide services to consumers and entrepreneurs, provided that the provisions of these Terms and Conditions do not limit the rights of consumers arising from mandatory provisions of law.
- SuperGlobal may refuse to accept a parcel or withdraw from the performance of the service in cases specified in these Terms and Conditions, the Price List, applicable law or the terms of a given service.
§ 4. Conclusion of the Agreement and Acceptance of the Parcel
- The proof of conclusion of an agreement for the provision of a postal service is a shipping document or another equivalent document, including one generated electronically.
- The shipping document should contain at least:
- identification of the Sender;
- identification of the Ordering Party, if different from the Sender;
- identification of the Recipient;
- delivery address;
- contact details, if required;
- description of the parcel contents;
- weight, dimensions and value of the parcel, if required;
- country of delivery;
- parcel number;
- indication of additional services, if ordered.
- Ordering the service constitutes confirmation by the Ordering Party or Sender that the data provided in the shipping document is true, complete and accurate and that the Ordering Party or Sender has read and accepted these Terms and Conditions and the Price List.
- Acceptance of a parcel for processing may be confirmed in particular by a parcel number, label, scan, signature, electronic status, confirmation of posting, acceptance protocol or another system record used by SuperGlobal.
- From the moment of acceptance of the parcel, SuperGlobal is responsible for the physical safety and quantity of accepted parcels until delivery to the Recipient, return to the Sender or performance of another instruction in accordance with these Terms and Conditions, unless the damage results from circumstances for which the Operator is not liable.
- Acceptance of a parcel does not constitute confirmation that its contents correspond to the Sender's declaration, unless the parties have expressly agreed on a contents inspection service.
- SuperGlobal may use electronic devices to confirm posting, acceptance, movement or delivery of a parcel. The Ordering Party, Sender and Recipient accept the possibility of confirming these actions electronically, including by electronic signature, system record, collection code, scan or another electronic trace of parcel handling.
§ 5. Obligations of the Sender and the Ordering Party
- The Sender or Ordering Party is obliged to properly prepare the parcel for posting.
- The Sender or Ordering Party is obliged to provide true, complete and up-to-date data concerning:
- the Sender;
- the Ordering Party;
- the Recipient;
- the delivery address;
- the contents of the parcel;
- the value of the parcel;
- the weight and dimensions of the parcel;
- data required for customs handling;
- data required for delivery of the parcel;
- other data required for the performance of the service.
- The Sender or Ordering Party is liable for the consequences of providing false, incomplete, outdated or inaccurate data, or data inconsistent with the actual contents of the parcel.
- The Sender or Ordering Party is obliged to provide SuperGlobal with all documents required by law, customs authorities, public authorities, carriers, postal operators, logistics partners or other entities involved in the performance of the service.
- The Sender or Ordering Party guarantees that the contents of each parcel are correctly declared and described in the shipping document.
- The Sender or Ordering Party is obliged to cover costs, fees, public charges, sanctions, penalties, storage costs, return costs, additional handling costs or other justified costs arising from providing false, incomplete or outdated data, sending a parcel inconsistent with these Terms and Conditions or violating applicable law.
§ 6. Packaging and Preparation of the Parcel
- The Sender is obliged to hand over the parcel to SuperGlobal in a condition enabling its proper movement and delivery without loss or damage.
- The parcel should be packaged in a manner appropriate to its contents, value, weight, dimensions, route, method of transport and requirements of the country of delivery.
- The packaging should:
- be closed and secured with an effective means;
- be sufficiently durable and tight;
- protect the contents against damage, loss, crushing, flooding, contamination or other impact;
- prevent access to the contents without leaving visible traces;
- bear appropriate markings if required by the nature or contents of the parcel;
- not contain elements that could damage other parcels, property or persons;
- meet the parameters specified in these Terms and Conditions, the Price List and applicable law.
- Packaging and securing of the parcel are included in its weight.
- If a parcel is unpackaged or improperly packaged, SuperGlobal may refuse to accept the parcel or repackage it at the expense of the Ordering Party.
- SuperGlobal may repackage a parcel if necessary to protect the parcel, other parcels, persons, property, the safety of handling or compliance with law.
§ 7. Prohibited and Restricted Items
- SuperGlobal may refuse to accept a parcel or withdraw from the performance of the service after acceptance if the parcel contains items that are prohibited, restricted or not permitted for acceptance, movement, transit, export, import or delivery.
- Prohibited or restricted items include in particular:
- dangerous, flammable, explosive, corrosive, foul-smelling or radioactive materials;
- weapons, ammunition and weapon parts;
- narcotics, psychotropic substances, intoxicants and other psychoactive substances;
- alcohol, tobacco and other excise goods;
- live animals and plants, if their transport is not permitted or requires special permits;
- human or animal remains;
- cash, currencies, securities, transferable instruments, payment cards, credit cards, vouchers and other negotiable items;
- works of art, monuments, antiques, jewellery, precious stones and precious metals, unless the Operator expressly permits such service on individual terms;
- identity documents, licences, permits and other documents of special value, unless the given service permits their shipment;
- goods infringing intellectual property rights;
- goods subject to sanctions, export or import restrictions;
- food requiring special transport conditions;
- medicines, supplements, medical devices and products requiring permits, certificates or special transport conditions;
- goods whose acceptance, movement or delivery is prohibited by the laws of the country of dispatch, transit or delivery;
- goods indicated on the Operator's website as prohibited or restricted;
- goods whose handling could expose the Operator, subcontractors, other parcels, third parties or property to damage.
- A detailed list of prohibited and restricted items may be published on www.superglobal.com.
- The Sender or Ordering Party is liable for sending a parcel containing prohibited or restricted items, unless such liability is excluded by mandatory provisions of law.
- If it is established that a parcel contains prohibited or restricted items, SuperGlobal may suspend performance of the service, secure the parcel, refuse further processing, return the parcel to the Sender, refer the matter to competent authorities or take other actions required by law.
§ 8. Parcel Verification
- Before accepting a parcel, SuperGlobal may request the Sender to open it in order to verify whether the parcel corresponds to the declarations contained in the shipping document and whether it contains prohibited or restricted items.
- After accepting a parcel, SuperGlobal may verify the parcel and its contents if there is a justified suspicion that the parcel contains prohibited or restricted items, items inconsistent with the declaration, or items that do not meet the requirements of these Terms and Conditions, the Price List or applicable law.
- SuperGlobal may suspend performance of the service, secure the parcel, refuse further performance of the service, notify competent authorities or take other actions required by law.
- Acceptance of a parcel for handling does not constitute confirmation that the contents, value, weight, dimensions, packaging or documents of the parcel are consistent with the declaration of the Sender or Ordering Party.
§ 9. Weight, Dimensions and Fee Adjustment
- The price of the service may depend on actual weight, dimensional weight, dimensions, country of delivery, method of posting, method of delivery, declared value, additional services and other parameters specified in the Price List.
- SuperGlobal has the right to verify the weight, dimensions and parameters of the parcel.
- Any change in weight, chargeable weight or fee resulting from verification should be supported by proof of weighing or measurement, including at least the date, place, parcel number and result of weighing or measurement.
- The Ordering Party may dispute the adjusted weight, dimensions or fee within 5 business days of receiving information about the adjustment.
- Until the dispute is resolved, the Ordering Party is obliged to pay the undisputed part of the amount due.
- If the Ordering Party or Sender provides weight, dimensions or parcel parameters that are inconsistent with the actual state, SuperGlobal may charge a fee according to the actual parcel parameters and the Price List.
§ 10. Prices, Fees and Settlement Currency
- The fee for the service and other activities related to its performance is determined according to the currently applicable SuperGlobal Price List, unless the parties have agreed individual terms.
- The Price List is available at www.superglobal.com.
- The basic currency of the Price List is PLN.
- For business customers, prices may be presented as net prices if this is expressly indicated.
- For consumers, prices are presented as gross prices if the service is offered to consumers.
- Prices in EUR may be presented in the Price List for auxiliary and informational purposes only.
- If the customer chooses payment in EUR, the amount payable will be converted from PLN to EUR according to the average EUR exchange rate published by the National Bank of Poland on the last business day preceding the day the service order is placed, unless an individual offer, agreement or invoice indicates a different exchange rate or a different conversion date.
- Before making payment in EUR, the customer should receive information about the amount in PLN, the applied exchange rate, the exchange rate date and the amount payable in EUR.
- The amount in EUR is rounded to two decimal places.
- Bank fees, payment operator commissions, currency conversion costs charged by the customer's bank or other costs of payment institutions are not part of the SuperGlobal Price List and may be charged to the customer in accordance with the rules applied by the customer's bank or payment provider.
- Only fees indicated in the Price List, accepted by the Ordering Party or resulting from applicable law may be added to the price.
- Additional fees may include, in particular, fuel, energy, seasonal and customs surcharges, non-standard parcel fees, repacking, return, additional parcel protection, confirmation of posting or delivery, failed pickup fees or other fees indicated in the Price List.
- Services and additional fees are not subject to discounts, unless the parties agree otherwise.
- Customs duties, taxes, import charges, public charges and other amounts required by customs or public authorities are not part of the postal service price, unless the Price List, offer or agreement expressly provides otherwise.
§ 11. Standard International Service of SuperGlobal Sp. z o.o.
- This Price List is effective as of 01.06.2026 and replaces previous price lists concerning the same services.
- The Price List applies to standard parcels in international traffic.
- The basic currency of the Price List is PLN. Prices in EUR are auxiliary and informational.
- Prices for consumers are gross prices, provided that the service is offered to consumers.
- Prices for business customers may be determined individually in an agreement, commercial offer or customer panel.

- Amounts in EUR indicated in the Price List are approximate. In the case of payment in EUR, the binding amount in EUR is calculated in accordance with the conversion rules set out in § 10 of these Terms and Conditions.
- Standard delivery times are expressed in business days and may depend on the country of delivery, customs procedures, completeness of data, the work of carriers, postal operators, logistics partners and public authorities.
- Fuel, energy, seasonal or other fees indicated in the Price List may be added to the price of each parcel if applicable on the date of posting.
- For consumers, the final price of the service, including mandatory fees known to the Operator before the service is ordered, should be presented before the order is placed.
- Prices do not include customs duties, taxes, import charges, public charges or other amounts required by customs or public authorities, unless the Price List, offer or agreement expressly provides otherwise.
- For parcels exceeding 30 kg, non-standard parcels, parcels requiring special handling, parcels of increased value or parcels to countries not indicated in the Price List, an individual quote, individual offer, agreement or quotation available in the customer panel shall apply.
§ 12. Services and Additional Fees

- Exceeding technical limitations applies in particular to a package longer than 175 cm, a package whose girth exceeds 300 cm, or a package heavier than 31.5 kg according to actual or dimensional weight. The fee may be charged for exceeding one of the indicated parameters.
- Services and additional fees are not subject to discounts, unless the parties agree otherwise.
- If an additional fee is not specified in the Price List, its amount should be agreed with the Ordering Party before the service is performed, unless incurring such fee is necessary to protect the parcel, other parcels, persons, property, to fulfil a legal obligation or to avoid damage.
- Amounts in EUR indicated for additional fees are approximate. In the case of payment in EUR, the binding amount is calculated in accordance with the conversion rules set out in § 10 of these Terms and Conditions.
§ 13. Customs Handling
- The Sender or Ordering Party is obliged to provide true, complete and up-to-date data required for customs handling.
- SuperGlobal may refuse to perform the service, suspend its performance or request additional information if the customs data is incomplete, false, inconsistent or insufficient.
- The Sender or Ordering Party is liable for the consequences of providing incorrect, incomplete or outdated customs data.
- Customs duties, taxes, import charges, administrative fees and other public charges may be charged to the Sender, Ordering Party or Recipient in accordance with applicable law, service terms and arrangements between the parties.
- If SuperGlobal collects or arranges the collection of customs or tax charges from the Recipient, it acts only to the extent necessary to perform the postal service and handle the parcel.
- The Sender or Ordering Party is obliged to submit required declarations and provide data concerning parcels containing goods, including data required by customs, sanitary, veterinary, phytosanitary or other regulations concerning goods control.
- SuperGlobal may refuse to accept or further handle a parcel if its contents, documents, data or country of delivery require actions that SuperGlobal does not perform or that cannot be performed lawfully.
§ 14. Cash on Delivery
- If a given service includes collection of payment from the Recipient, the cash on delivery service is auxiliary to the postal service.
- Cash on delivery consists of arranging the collection of a specified amount from the Recipient for the delivered goods or parcel and transferring it to the Ordering Party under the terms specified in these Terms and Conditions, the Price List, agreement or offer.
- SuperGlobal does not maintain payment accounts for Ordering Parties or Recipients and does not provide independent payment services, unless it has the legally required authorisations or uses an entity holding such authorisations.
- The terms, deadlines and costs of cash on delivery settlement should be specified in the Price List, agreement or offer.
- SuperGlobal may refuse to perform cash on delivery if there is a risk of violating law, transaction security rules, payment restrictions, sanctions, anti-money laundering regulations or rules applied by payment operators.
§ 15. Delivery of the Parcel
- After acceptance for processing, the parcel is delivered in accordance with the data and instructions contained in the shipping document.
- Delivery may be made to the Recipient's address, a pickup point, a parcel locker or in another manner provided for a given service.
- Delivery may be confirmed by signature, electronic status, collection code, photo, scan, system confirmation or another method used for a given service.
- If the Recipient refuses to accept the parcel, the parcel may be returned to the Sender at the expense of the Ordering Party, unless the parties agree otherwise.
- If delivery of the parcel is impossible for other reasons, SuperGlobal informs the Ordering Party of this circumstance and may set a deadline for providing further instructions.
- In the absence of instructions within the specified deadline, the parcel may be returned to the Sender, placed in storage or handled in accordance with applicable law and these Terms and Conditions.
§ 16. Returns, Storage and Undeliverable Parcels
- An undelivered parcel may be returned to the Sender, placed in storage or handled in accordance with the instructions of the Ordering Party.
- If a parcel cannot be delivered to the Recipient or returned to the Sender due to the absence of, incorrect or incomplete Sender address, the parcel may be deemed undeliverable.
- An undeliverable parcel may be opened in order to obtain data enabling its delivery or return to the Sender, in accordance with applicable law.
- Activities related to opening undeliverable parcels and establishing data enabling their delivery or return are performed in the SuperGlobal organisational unit responsible for handling such parcels.
- No parcel may be destroyed, disposed of or otherwise dealt with without prior instruction from the Ordering Party, unless required by law, a public authority, a customs authority, the safety of persons, property, other parcels or the environment.
- The costs of return, storage, redelivery or other handling of the parcel shall be borne by the Ordering Party, provided that they arise from the Price List, agreement, customer instruction or applicable law.
§ 17. Right of Lien
- SuperGlobal has a right of lien over postal parcels to secure claims arising from the agreement for the provision of a postal service and justified additional costs of service provision arising from reasons attributable to the Sender, Ordering Party or Recipient.
- The right of lien is exercised in accordance with applicable law.
- This paragraph does not apply to the extent that applicable law excludes the possibility of exercising the right of lien.
§ 18. Complaints
- Complaints concerning non-performance or improper performance of a postal service may be submitted:
- electronically to the e-mail address indicated by SuperGlobal;
- in writing to the registered office address of SuperGlobal;
- via a complaint form, if available;
- at a customer service point, if the point accepts complaints.
- If an electronic complaint form is made available, the person submitting the complaint may be identified or authenticated in particular by parcel number, Sender data, Recipient data, e-mail address, telephone number, authorisation code, customer account or other data allowing verification of the right to submit the complaint.
- The entities entitled to submit a complaint are:
- the Sender;
- the Ordering Party, if it is a party to the agreement for the provision of the postal service;
- the Recipient, if the parcel has been delivered to them;
- the Recipient, if the Sender or Ordering Party has waived its right to pursue claims in favour of the Recipient.
- The complaint should include:
- the name or first name and surname of the complainant;
- the address of the complainant;
- the parcel number;
- description of the event;
- title of the complaint;
- amount of the claim, if the complaint includes a monetary claim;
- documents confirming the validity of the complaint;
- contact details;
- signature of the complainant, if the complaint is submitted in writing;
- power of attorney document, if the complaint is submitted by a representative.
- A complaint may be submitted no later than within 12 months from the date of posting the parcel, unless mandatory provisions of law or applicable international regulations provide for another deadline.
- Visible damage to the parcel should be reported directly upon delivery or immediately after delivery.
- Hidden damage, shortage or discrepancy should be reported within 7 days from the date of delivery of the parcel.
- For e-commerce parcels, the reporting period may run from the day the Ordering Party receives a complaint from the Recipient, but no later than 14 calendar days from the delivery of the parcel, unless mandatory provisions of law provide for a longer period.
- A complaint submitted by an unauthorised person may be treated as not submitted, of which SuperGlobal informs the complainant, indicating the possibility of submitting the complaint by an authorised person.
- If the complaint does not contain data or documents necessary for its consideration, SuperGlobal may request the complainant to supplement the complaint.
- SuperGlobal considers the complaint within 30 days from the date of receiving the complete complaint, unless mandatory provisions of law or applicable international regulations provide for another deadline.
- The response to the complaint includes the decision on the complaint, justification, information on any compensation amount and the deadline and method of payment, if the complaint has been accepted in whole or in part.
- The complaint procedure is deemed exhausted if SuperGlobal refuses to accept the complaint or fails to pay the claimed amount within 30 days from the date of accepting the complaint.
- The provisions of this paragraph do not limit consumer rights arising from mandatory provisions of law.
§ 19. Operator's Liability and Compensation
- SuperGlobal is liable for non-performance or improper performance of the service under the terms set out in these Terms and Conditions, the Price List, the agreement and applicable law.
- SuperGlobal is liable for loss, shortage or damage to a parcel from the moment of acceptance until delivery to the Recipient, return to the Sender or performance of another instruction.
- SuperGlobal is not liable for damage resulting from:
- improper packaging of the parcel;
- providing false, incomplete or outdated data;
- sending prohibited or restricted items;
- the nature of the items contained in the parcel;
- decisions of public, customs, border or sanitary authorities;
- force majeure;
- fault of the Sender, Ordering Party or Recipient;
- failure of the Recipient to collect the parcel;
- refusal by the Recipient to pay customs, tax or other charges;
- other circumstances for which the Operator is not liable under applicable law.
- A parcel is deemed lost if it is not delivered to the Recipient within 30 days after the expected service completion deadline, unless applicable law, applicable international regulations or the terms of a given service provide for another deadline.
- If a complaint concerning loss, shortage of contents or damage to a parcel is accepted, SuperGlobal pays compensation in an amount corresponding to the actual and documented damage suffered, but not exceeding the declared value of the parcel, provided that the value was correctly declared and accepted by SuperGlobal.
- If the parcel was covered by additional protection, the amount of compensation may correspond to the declared value of the parcel, subject to the limits, exclusions and terms of additional protection specified in these Terms and Conditions, the Price List, offer or agreement.
- If the parcel was not covered by additional protection or its value was not correctly declared, the amount of compensation may be limited in accordance with these Terms and Conditions, the Price List, the terms of the given service and applicable law.
- In the event of non-performance of the service, SuperGlobal refunds the fee collected for the service if such obligation results from applicable law, these Terms and Conditions, the Price List, offer or agreement.
- Compensation is paid to the bank account indicated by the entitled person or in another agreed manner, within the deadline specified in the response to the complaint, no longer than 30 days from the date of accepting the complaint, unless applicable law or applicable international regulations provide for another deadline.
- SuperGlobal is not liable for lost benefits, profits, income, indirect damages or consequential damages, unless mandatory provisions of law provide otherwise.
- If a given service provides for a guaranteed delivery time, liability for breach of the guaranteed delivery time is determined by the Price List, offer, agreement or applicable law.
- If a given service does not provide for a guaranteed delivery time, the indicated delivery time is estimated and does not constitute a guarantee of delivery within a specific time.
- Limitations of liability do not apply to consumers to the extent that they would violate mandatory provisions of law.
§ 19a. Circumstances in which a postal service is deemed not performed or improperly performed
- A postal service is deemed not performed in particular where a postal item accepted by SuperGlobal for transportation and delivery has not been delivered to the Recipient, has not been released to an authorised person, has not been returned to the Sender and, in the course of the complaint procedure, its loss or the inability to determine its further status has been confirmed.
- A postal service is also deemed not performed where, after the conclusion of a postal service agreement and acceptance of the parcel, SuperGlobal has not performed the activities constituting the relevant service, unless the non-performance results from reasons attributable to the Sender, Ordering Party, Recipient, a third party, force majeure, or other circumstances excluding SuperGlobal’s liability under applicable law.
- A postal service is deemed improperly performed in particular in the event of:
- loss of part of the parcel contents;
- damage to the parcel or its contents;
- performance of the service in breach of a guaranteed delivery time, where such guaranteed delivery time was expressly provided for the relevant service;
- non-performance or improper performance of an additional service, where such service was ordered and paid for;
- any other breach of the terms of service set out in these Terms and Conditions, the Price List, agreement, offer, shipping document or applicable law.
- Exceeding an estimated delivery time does not automatically mean that the postal service has not been performed, unless a guaranteed delivery time was provided for the relevant service. In such a case, the delay may constitute grounds for a complaint if this follows from these Terms and Conditions, the Price List, agreement, offer or applicable law.
- The assessment of whether a postal service has not been performed or has been improperly performed is made on the basis of the available documentation, tracking data, proof of posting and delivery, transport documents, damage reports, correspondence with the Sender, Ordering Party or Recipient and the outcome of the complaint procedure.
- The provisions of this paragraph do not limit consumer rights arising from mandatory provisions of law.
§ 20. Additional Parcel Protection
- The Ordering Party may use additional parcel protection if such option is available for the given service.
- Additional protection requires declaration of the parcel value and payment of the fee indicated in the Price List.
- Additional protection does not cover prohibited, restricted or excluded items.
- Detailed terms of additional protection should be made available to the customer before the service is ordered.
- If additional protection is not insurance within the meaning of applicable law, SuperGlobal refers to it as "additional parcel protection".
- Using additional protection does not release the Sender or Ordering Party from the obligation to properly package the parcel, declare its actual contents and value and provide required documents.
§ 21. Force Majeure
- SuperGlobal is not liable for non-performance or improper performance of the service if it results from force majeure.
- Force majeure means external events that could not be foreseen and could not be avoided despite due diligence, in particular:
- war, hostilities, armed conflict or threat of conflict;
- border closure;
- import or export restrictions;
- decisions of public, customs, border or sanitary authorities;
- embargo, sanctions or transport restrictions;
- strikes, blockades, riots, acts of terror or sabotage;
- natural disasters;
- epidemics, pandemics and quarantines;
- long-term transport interruptions;
- failures of systems, infrastructure, transport networks or ICT networks independent of SuperGlobal;
- other events beyond the control of SuperGlobal.
- The occurrence of force majeure does not release the parties from the obligation to perform obligations after its effects cease, if performance remains possible.
§ 22. Personal Data Protection
- SuperGlobal processes personal data of Senders, Ordering Parties and Recipients only to the extent necessary to provide postal services, handle parcels, settlements, complaints, contact, fulfil legal obligations and protect claims.
- Data may include in particular first name and surname, company name, address, telephone number, e-mail address, parcel number, data concerning the parcel, customs data and data related to payments and complaints.
- Data may be transferred to subcontractors, carriers, postal operators, logistics partners, customs authorities, public authorities, payment operators and other entities if necessary for the performance of the service or required by law.
- In the event of transferring data outside the European Economic Area, SuperGlobal applies appropriate legal bases and safeguards required by personal data protection regulations.
- Detailed information concerning the processing of personal data is contained in the Privacy Policy or GDPR Information available on the SuperGlobal website.
- If required by law or by the nature of cooperation, the parties conclude a separate data processing agreement.
§ 23. Consumers and out-of-court consumer dispute resolution
- The provisions of these Terms and Conditions do not limit consumer rights arising from mandatory provisions of law.
- If any provision of these Terms and Conditions could be considered prohibited in relation to a consumer, it shall not apply to the consumer to the extent that it would violate their rights.
- In particular, provisions shall not apply to consumers if they:
- exclude or excessively limit SuperGlobal’s liability;
- prevent submission of a complaint;
- impose grossly excessive penalties;
- restrict court jurisdiction in a manner contrary to law;
- make consideration of a complaint dependent on payment of all amounts due, if this would be contrary to consumer law.
- After completion of the complaint procedure, if a dispute concerning a postal service has not been resolved, an eligible applicant may use the out-of-court consumer dispute resolution procedure conducted by the President of the Office of Electronic Communications.
- The out-of-court consumer dispute resolution procedure concerning postal services is conducted in accordance with Article 95 of the Act of 23 November 2012 — Postal Law, the Act of 23 September 2016 on Out-of-Court Consumer Dispute Resolution and the rules of procedure issued by the President of the Office of Electronic Communications.
- The procedure may be conducted upon the application of an eligible applicant or ex officio where this is required to protect consumer interests.
- Applications concerning postal services are examined by the Postal Market Department of the Office of Electronic Communications or by the competent local delegation of the Office of Electronic Communications, according to the applicant’s place of residence or registered office address.
- The application must be submitted in Polish.
- The application may be submitted:
- in paper form to the address of the Office of Electronic Communications or the competent local delegation of the Office of Electronic Communications;
- electronically via the ePUAP electronic public administration services platform;
- via the form available on the Electronic Services Platform of the Office of Electronic Communications;
- to an electronic delivery address, where such form is available under applicable law.
- The application should include in particular the identification of the parties to the dispute, the claim, the justification of the claim, documents supporting the applicant’s position, including the documentation of the completed complaint procedure, and the applicant’s signature where required for the relevant form of application.
- Detailed information on the out-of-court consumer dispute resolution procedure, including current forms and address details of the Office of Electronic Communications, is available on the website of the Office of Electronic Communications.
- The provisions of this paragraph do not exclude the consumer’s right to pursue claims before the competent common court.
§ 24. Amendments to the Terms and Conditions and the Price List
- SuperGlobal may amend these Terms and Conditions or the Price List.
- An amendment to the Terms and Conditions or the Price List should be published on www.superglobal.com before it enters into force.
- A new version of the Terms and Conditions or the Price List should include the effective date.
- The Terms and Conditions and Price List applicable on the date the service is ordered shall apply to the parcel, unless the parties agree otherwise.
- SuperGlobal may store archived versions of the Terms and Conditions and Price List in a manner enabling determination of the terms applicable on the date the service was ordered.
§ 25. Final Provisions
- These Terms and Conditions are available on www.superglobal.com.
- The Ordering Party and Sender are obliged to read these Terms and Conditions before handing over a parcel to SuperGlobal.
- In matters not regulated by these Terms and Conditions, generally applicable law shall apply.
- If any provision of these Terms and Conditions proves invalid or ineffective, this shall not affect the validity of the remaining provisions.
- These Terms and Conditions enter into force on 01.06.2026.
- If these Terms and Conditions are published in more than one language version, the Polish language version shall prevail in the event of discrepancies, unless mandatory provisions of law provide otherwise.
